Article III. – Section. 1. — Second American Constitution

The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services a Compensation, which shall not be diminished during their Continuance in Office.

Article 3. – Section. 1. — Items 1 through 3 of the Third American Constitution

Item One

The Judicial Power of the “Direct Democracy Republic Of The United States Of America”, shall be vested in one “Supreme Court”, subject to the consent and over rule of the “Grand Jury Of The American People” and the “Peers Of America” the special branch of the “Volunteer House Of The American People, with its “Sea to Sea National Support and Voter Network” and in such special scrutiny and evaluation courts as the Three Houses Of American Direct Democracy Governance, may advise, ordain and establish.

The “Peers Of America” are selected Citizen Volunteers, that have studied law, justice systems and a course on “Moral Judgment Considerations”. It is hoped that enough Citizens, across the nation, will undergo this special training and education, so that acceptable duty requirements will enable the “Peer” to return to their normal daily Life schedule after three trials at the Federal Level and Three Trials at the State Level. After this service the specially educated “Peer” will be on the standby roster for one year at which time they will be replaced by a new specially educated “Volunteer Peer”.

 

Intention:

The intention of Item 1, is to be a functional daily Justice expression of the Direct Democracy Principle that states that the more educated and trained minds that address a problem, the more Fair the solution will be.

Item Two

Some of the “Peers Of America”, being in acceptance of the responsibility, will go on to two years service in the “Grand Jury Of The American People”. This additional assignment will be a selection decision of the “Supreme Court Of The Direct Democracy Republic Of The United States Of America”, and the “Grand Jury Of The American People”.

Intention

 

The intention of the suggestion in “Item Two” is to insure adequate Citizen participation in the judicial process, without adding to the already heavy deliberation, discussion and decision vote roster of national and state legislative caseloads that requires servicing every day and night. The key, to the trustworthiness of this approach to Our judicial system, is the special education undergone to acquire the best skills of this service.

Item Three

The Judges, both of the Supreme and “Special Scrutiny Courts”, shall hold their Offices during “good behavior”, and shall, at the end of their terms, receive for their Services a generous additional Compensation, which shall not be diminished during their Continuance in Office and be awarded at the end of their judicial service.

“Good Behavior” in this context would include high intelligence, wisdom and dedication of self to this critical national calling, that functions under Direct Democracy Principles Of Service To The Many.

Intention

The intention of Item 3 is to give a special reward (above the maximum level afforded by the “American Earned Guaranteed Income”, to those that served all the way up through two years of service in the ‘Supreme Court” and the “Special Scrutiny Courts”.

The service in the “Grand Jury Of The American People” would be considered the highest “non-extra-wealth-rewarded” volunteer judicial service, but, along with other benefits, would be a highly honored and recognition rich attainment that earns the engraved name of the “PaDeci” on the walls of the Central Governance Facility in South Dakota.

Article 3 – Section. 2. Of the Second American Constitution

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;–to all Cases affecting Ambassadors, other public Ministers and Consuls;–to all Cases of admiralty and maritime Jurisdiction;–to Controversies to which the United States shall be a Party;–to Controversies between two or more States;– between a State and Citizens of another State,–between Citizens of different States,–between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

Article 3 – Section. 2. — Items 1 through Of The American Third Direct Democracy Constitution

 

Item One

The American Judicial Powers of the “Supreme Court”, the “Grand Jury Of The American People” and the lower Federal and State Courts, will always be selected and ratified by Majority Vote of The American True Citizens and shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the Direct Democracy Republic Of The United States Of America.

The State Courts Judicial Seats can be decided by the True Citizens of that State, with the provision that tie votes can be resolved by the Citizens of the whole nation. Since a tie vote can be resolved with only one vote, the Citizens of the State with the tie can select and request any qualified Citizen outside their State to cast their vote for this purpose.

But it is recommended that Many Votes be sought, in order to deny any chances for vote corruption in this matter.

Item Two

 

Treaties made, or which shall be made, under “American True Citizen Final Decision and Authority”;

–in all Cases affecting Ambassadors, (When “Diplomatic Immunity” is abused through violation of American Law, it will be forfeited and the Ambassador or Consulate Staff Member will become subject to American Law)

involving other public Ministers and Consuls;–

involving all Cases of “Admiralty and Maritime Jurisdiction”;

involving Controversies to which the United States shall be a Party;

involving Controversies between two or more States;

involving controversies between a State and Citizens of another State,

involving controversies between Citizens of different States,

involving controversies between Citizens of the same State claiming Lands under Grants of different States, in different States

and controversies between a State, or the Citizens thereof, and Foreign States, Citizens or Subjects”

“shall never go against the Sovereign Will Of The True Direct Democracy Citizen American People.

 

Item Three

In all Cases affecting Ambassadors, “other” Public Ministers and Consuls, and those in which State Governance shall be Party, the “Supreme Court” and the “Grand Jury Of The American People” shall have original Jurisdiction, but its decisions are always subject to Majority ratification of The People through the “Volunteer House Of The American People” with its “Sea to Sea National Support and Vote Network”. In all the other Cases before mentioned, the Supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Three Houses Of Governance and the “Grand Jury Of The American People”, shall make.

Item Four

The Trial of all Crimes, shall be by Jury assembled out of volunteers of the “Peers Of America”; and such Trial shall be held in the State where the said Crimes shall have been committed.

But when not committed within any State, (for example in Washington D.C., or the “Central Governance Facility” in South Dakota) the Trial shall be at such Place or Places as the Three Houses Of Governance may, by Law, have directed.

 
Article 3 – Section. 3. Of the Second American Constitution

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

Section. 3.

Treason against the Direct Democracy United States Of America, shall consist only in levying War against Us, or in adhering to Our Enemies, giving them Aid and Comfort”including sabotage or other “harmful undermining” the various National Structures of Our Culture. No Person shall be convicted of Treason unless on the Testimony of two True Witnesses to the same overt Act, or on Confession in Open Court of the “Supreme Court” and the “Grand Jury Of The American People”.

The Three Houses Of Governance shall have Power to declare the Punishment for a conviction of Treason, but no Attainder of Treason shall work Corruption of Blood???, or Forfeiture except during the Life of the Person attainted. (?)
